After the corporate scandals at the beginning of the new millennium, corporate governance codes were drafted and implemented in national laws and regulations. Unfortunately, due to an ongoing supply of new financial scandals and societal deceptions, our society increasingly distrusts executive directors, non-executive directors and supervisory board members, as they often appeared to play a significant role in these scandals. Nonexecutive directors (NEDs) and supervisory directors (SDs) are often accused of having overlooked the important issues in their supervising role or (...) having failed to intervene in company decision making. Previous research has shown that many NEDs and SDs operate on the basis of their own unwritten rules, which may very well be different from those of their colleagues. In this article we examine whether and how a code of conduct or code of ethics might help to further clarify how NEDs/SDs should act. We also investigated the views of NEDs/SDs themselves. It appears that current corporate governance codes are not sufficient to guide directors on behavioral aspects of their supervisory role. This article shows that a code of conduct could provide this guidance to NEDs/SDs on several issues. First, a code of conduct would compel the Supervisory Board to reflect on its own values. Second, it would compel NEDs/SDs to verbalize their unwritten rules. The results may be applied internationally and could have relevance to the experience of executive directors in addition. This article may serve as a discussion document for other jurisdictions in addition. (shrink)

Background In the ethical and clinical literature, cases of parents who want treatment for their child to be withdrawn against the views of the medical team have not received much attention. Yet resolution of such conflicts demands much effort of both the medical team and parents. Objective To discuss who can best protect a child9s interests, which often becomes a central issue, putting considerable pressure on mutual trust and partnership. Methods We describe the case of a 3-year-old boy with acquired (...) brain damage due to autoimmune-mediated encephalitis whose parents wanted to stop treatment. By comparing this case with relevant literature, we systematically explored the pros and cons of sharing end-of-life decisions with parents in cases where treatment is considered futile by parents and not (yet) by physicians. Conclusions Sharing end-of-life decisions with parents is a more important duty for physicians than protecting parents from guilt or doubt. Moreover, a request from parents on behalf of their child to discontinue treatment is, and should be, hard to over-rule in cases with significant prognostic uncertainty and/or in cases with divergent opinions within the medical team. Children and adults with dementia are vulnerable populations. Both groups are also relatively seldom included in biomedical research. However, including them in clinical trials is necessary, since both groups are in need of scientific innovation and new therapies. Their dependence and limited decision‐making capacities increase their vulnerability, necessitating extra precautions when including them in clinical trials. Beside these similarities there are also many differences between the groups. The most obvious one is that children have an entire life ahead of them (...) and will become persons with certain ideals and preferences, while adults with dementia have lived a life in which they have expressed their ideals and preferences. Some of the available research guidelines recognize these differences, setting one list of specific requirements for groups of incapacitated adults and another list for children. Other documents, however, do not differentiate and only set requirements for subjects unable to consent as a single category of subjects.In this article we analyse to what extent the similarities and differences between the two groups are represented in legal documents and ethical guidelines. The article presents an overview and an analysis of the requirements for doing research with children and dementia patients. We conclude with suggestions about how to better incorporate the morally relevant aspects of these two groups in legislation and ethical guidelines. (shrink)

This article focuses on how leaders of new right-wing populist parties are portrayed in the mass media. More so than their established counterparts, new parties depend on the media for their electoral breakthrough. From a theoretical perspective, we expect prominence, populism, and authoritativeness of the party leaders' media appearance to be essential for their electoral fortunes. We used systematic content analyses of 17 Dutch media outlets during the eight weeks prior to the 2006 national elections and compared the appearances of (...) four right-wing populist and seven mainstream party leaders. This article makes two contributions to the existing literature: First, we develop valid and reliable indicators of authoritativeness and populism and apply them to a systematic content analysis. Second, we show that more successful right-wing populist leaders were more prominent during the election campaign and that the most successful right-wing populist leader also appears more authoritative in the news. Environmental pollution, animal diseases, and food scandals have marked the agricultural sector in the Netherlands and elsewhere in the 1990s. The sector was high on the political and societal agenda and plans were developed to redesign the sector into a more sustainable direction. Generally, monitoring of the agricultural sector is done by means of quantitative indicators to measure social, ecological, and economic performance. To give more attention to the normative character of sustainable development, the Dutch Ministry of Agriculture, Nature, and (...) Food Quality requested for a participatory approach to evaluate Dutch agriculture, which was characterized by stakeholder workshops, dialogue, and learning. This article describes and reflects on this approach, using the Fourth Generation Evaluation framework developed by Guba and Lincoln (Fourth generation evaluation, 1989). Although there are several improvements to be made, the evaluation approach was successful in the way that it gave insight into perceptions, visions, and ambitions of agricultural stakeholders with regard to sustainability. It also encouraged learning about ways to make the agricultural sector more sustainable. And it contributed to the development of a monitoring approach that is complementary to the quantitative, indicator-based, evaluation approach that is generally used and that can be used every few years to see how perceptions and ambitions of stakeholders have developed. In this article we explore the ethical issues raised by permitting patients to pay for participation (P4) in clinical trials, and discuss whether there are any categorical objections to this practice. We address key considerations concerning payment for participation in trials, including patient autonomy, risk/benefit and justice, taking account of two previous critiques of the ethics of P4. We conclude that such trials could be ethical under certain strict conditions, but only if other potential sources of funding have first been (...) explored or are unavailable. (shrink)

In this manuscript, we introduce a theoretical model of climate radicalization that integrates social psychological theories of perceived unfairness with historical insights on radicalization to contribute to the knowledge of individuals’ processes of radicalization and non-radicalization in relation to climate change. We define climate radicalization as a process of growing willingness to pursue and/or support radical changes in society that are in conflict with or could pose a threat to the status quo or democratic legal order to reach climate goals. (...) We describe how perceptions of unfairness can play a pivotal role in processes of climate change related radicalization. Without taking any position or judgment regarding climate concerns and associated actions, we suggest that although these behaviors drive many people to participate in peaceful climate protest, they may also lead others to radicalize into breaking the law to achieve their climate goals, possibly in violent ways. This process of climate radicalization, we argue, can be driven by people perceiving certain situations to be blatantly unfair. Specifically, we discuss how radical attitudes and behaviors can be products of perceived unfairness stemming from the past, the future, the immediate social environments of perceivers, as well as those that are spatially distant from them. We further argue that because radicalization processes are shaped by an interaction between individuals and movements, on the one hand, and societal actors and developments, on the other, they tend to develop in non-linear and dynamic ways. We therefore propose that climate radicalization is a dynamic, contingent, and non-linear process, often of an escalating kind, that develops over time, through various interactions between individuals and their contexts, and in which people and groups move back and forth from peaceful protest, through disobedient and unlawful methods, to violent actions. This edition of Zeraḥyah's Hebrew translation of _De Anima_, Aristotle's monograph on the soul, is of major importance for the history of transmission of Aristotle's text in the Middle Ages. Zeraḥyah's translation is based on the same lost Arabic translation as Averroes' long commentary, and the solution which it provides for the question of the authorship of this lost Arabic translation thus also holds good for Averroes' text.

This paper contains a Dutch translation of the important text of Hippolytus of Rome on the Gnostic theology of Basilides of Alexandria. The historiographical concept "Enlightenment" has for a long time wavered between the idea of a single unified Enlightenment and the notion of multiple competing enlightenments. This volume revisits this seeming contradiction by asserting that the Enlightenment should be understood as a shared process of communication, seeking ways to accommodate and mediate rival ideologies and orient enlightenment projects towards the betterment of humankind. Taking the work of the eminent Enlightenment scholar Hans Erich Bödeker as their point of departure, the different chapters (...) seek to explore this perspective through specific case studies of political communication. Readers are offered a selection of Bödeker's texts never previously translated into English, along with a series of contributions from his former colleagues, students, and collaborators. In doing so the book displays the broad scope of Bödeker's own work, as well as the multiplicity of themes captured within the framework of the Enlightenment. Genres, modes, and strategies of communication are contrasted with the institutions and cultural practices underpinning them. In exploring the depth and scope of Bödeker's work, the volume pays tribute to a German tradition rooted in historical semantics, while at the same time querying its present state and its future. Bo Mou steuert einen eigenständigen Beitrag zu einer zeitgemäßen Lesart des Yijing bei, der sich nur ganz am Rande mit der Philosophie Uwe Meixners – und hier mit der Idee eines Ausgleichs zwischen den konfligierenden Strebungen der einzelnen Substanzen – beschäftigt. Bo Mous Artikel zeigt sehr deutlich, wie viel von der Wahl der primären Kategorien abhängt, wenn es darum geht theoretisch zu erschließen, was als “echter Aspekt der Welt” gelten kann und was nicht.
